The  Small Business Development Center is hosting a webinar about the SBA’s upcoming Restaurant Revitalization Fund on Thursday, April 29, 2021 at 2:30pm. This is another opportunity to let your businesses know the SBDC has FREE Advisors to offer Technical Assistance for this and any other funding sources.

 SBA is awarding funds through the Restaurant Revitalization Program to restaurants, bars, and other similar places of business that serve food or drink. The purpose of this funding is to provide support to eligible entities that suffered revenue losses related to the COVID-19 pandemic.

 As President Joe Biden signed the PPP Extension Act of 2021 into law today, extending the Paycheck Protection Program an additional two months to May 31, 2021, and then providing an additional 30-day period for the SBA to process applications that are still pending, Administrator Isabella Casillas Guzman, head of the U.S. Small Business Administration, said:

“Today, President Biden sent another strong message to America’s more than 30 million small business owners negatively impacted by the pandemic: help is here. By signing the PPP Extension Act of 2021 and the American Rescue Plan Act into law, the President is providing additional critical relief to the smallest of the small businesses – the mom-and-pop shops that line our Main Streets and keep our local and regional economies going.

“The leadership of the Biden-Harris Administration, working with leaders of the House Small Business Committee, Chairwoman Nydia Velázquez, and Ranking Member Blaine Luetkemeyer, Reps. Starting March 17, San Diego County can operate in Tier 2, or Red Tier, of the state’s Blueprint for a Safer Economy

Among changes from Purple Tier:

  • Restaurants can operate indoors at 25% capacity or 100 people, whichever is fewer.
  • Gyms and fitness centers can open indoors at 10% capacity.
  • Museums, zoos and aquariums can open indoors at 25% capacity.
  • Movie theaters can open indoors at 25% capacity or 100 people, whichever is fewer.
  • Retail and shopping centers can operate indoors at 50% capacity.

Reopening steps for Businesses

Following guidance for your business or activity, complete the County’s Safe Reopening Plan. You need to post the plan at your entrance and discuss it with employees. Restaurants, food, and beverage providers have a separate plan. See industry guidance and resources for restaurants, food, and beverage providers. Each business’s plan may need to be updated and reposted when state guidance changes. Open with safety precautions:

  • Critical infrastructure (when a remote option is not possible)
  • Non-urgent medical and dental care
  • Child care and pre-K

Open with additional modifications

The following sectors will have additional modifications in addition to 100% masking and physical distancing. Links are to state guidance.

Closed

Operations in the following must be closed:

  • Indoor playgrounds
  • Indoor recreational facilities
  • Live audience sports
  • Amusement parks
  • Live concerts (drive-in concerts allowed)
  • Conventions

Schools

State guidance regarding K-12 schools.

Schools that are currently open are able to continue to provide in-person instruction on school sites.

  • Schools that are currently operating under an elementary school waiver are able to continue to provide instruction to students on school sites.
  • Schools that reopened while their county was in a less restrictive tier are able to continue to provide instruction to students on school sites.

Outdoor recreation

You can go out for exercise if you can keep six feet away from people who are not members of your household. Avoid groups and crowded outdoor spaces. Wear a face covering when within six feet of others.

If you are a solo practitioner or super small business the PPP has created a window of opportunity especially for you!

On Monday, February 22, President Biden announced that beginning today, Wednesday, February 24 through March 10, the SBA has established a 14-day, exclusive PPP loan application period for businesses and nonprofits with fewer than 20 employees. This will give lenders and community partners more time to work with the smallest businesses to submit their applications, while also ensuring that larger PPP-eligible businesses will still have plenty of time to apply for and receive support before the program expires on March 31, 2021.

SBA also announced four additional changes to open the PPP to more underserved small businesses than ever before. While these changes are being implemented, SBA will work with community partners to improve the emergency relief “digital front door” and conduct extensive stakeholder outreach. And, SBA will strengthen its relationships with lender partners to advance equity goals, deliver funding efficiently, and prevent fraud, waste, and abuse. SBA will:

  • Allow sole proprietors, independent contractors, and self-employed individuals to receive more financial support by revising the PPP’s funding formula for these categories of applicants;
  • Eliminate an exclusionary restriction on PPP access for small business owners with prior non-fraud felony convictions, consistent with a bipartisan congressional proposal;
  • Eliminate PPP access restrictions on small business owners who have struggled to make student loan payments by eliminating student loan debt delinquency as a disqualifier to participating in the PPP; and
  • Ensure access for non-citizen small business owners who are lawful U.S. residents by clarifying that they may use Individual Taxpayer Identification Number (ITIN) to apply for the PPP.

A critical goal from Congress for the latest round of PPP was to reach small and low- and moderate-income (LMI) businesses who have not received the needed relief a forgivable PPP loan provides. Congress set a $15B set-aside for small and LMI first draw borrowers. With existing policies, the current round has only deployed $2.4B to small LMI borrowers, in part because a disproportionate amount of funding in both wealthy and LMI areas is going to firms with more than 20 employees. The less than 20 exclusivity period combined with the changes to expand access for sole proprietors, ITINs, returning citizens, and student loan debt will help us achieve Congressional goals.

This month the City of San Diego Fire Marshal is scheduled to visit all areas of the City, including La Jolla, to meet with those businesses which have set up outdoor business operations due to COVID regulations.  The Fire Marshal is dedicated to keeping visitors safe and will answer questions about the use of heaters, tents, decks, and other structures.  Deputy Fire Marshals will be in La Jolla on February 17 and 18.  See the entire Fire Marshal Inspection Schedule HERE.

Staying safe does not have to be expensive.  There are multiple no- and/or low-cost options available to support compliance efforts.

FIRE SAFETY

Please see the below links for important information regarding the use of heaters, and COVID19 indoor/outdoor definitions for the use of tents and temporary structures. A business may be required to obtain a permit by completing and submitting this permit application from the San Diego Fire-Rescue Department if they currently have, or propose to install, a tent or temporary structure covering more than 400 square feet. Attachments include:

DECKS, PLATFORMS, AND OTHER TEMPORARY OUTDOOR BUSINESS OPERATIONS

The following options are available to help dining and retail outlets open or expand operations outdoors so they can cost-effectively maintain safety, health, and distancing protocols.

  • No-construction Option: Most previously issued Temporary Outdoor Business Operations Permits allow for business operations to exist in the public right-of-way during regular business hours.
  • Simple Deck/Platform: The City Engineer recently issued pre-approved specifications that may be used with no additional architectural or engineering services to apply for a new Temporary Outdoor Business Operations Permit or amend an existing one.
  • Custom Deck/Platform: Submitted permit drawings must be signed and stamped by a responsible design professional such as a registered Civil or Structural Engineer licensed in the State of California.

The opening page captures programs that are available nationally. Visitors then only need to enter a ZIP code of interest to see which programs their area may be eligible. The information is current as of the date of publication, so resource availability may change over time.

Funding providers may submit requested updates, additions, or corrections to the data by emailing the information to EconRecovery@sba.gov for evaluation and update.

Supervisor Nathan Fletcher, The San Diego & Imperial Small Business Development Center (SBDC), and The San Diego Foundation have once again partnered to make sure business owners and non-profit leaders can access the available resources. Starting today, businesses and nonprofits can sign-up to secure a share of $500 million in state funds here.

“It’s been a very difficult year for the business community, particularly our small businesses; that is the reason we have worked hard to provide relief and help during this difficult time. I am excited to work with the San Diego & Imperial SBDC Network and The San Diego Foundation again to deliver funding, information, and technical support for businesses and nonprofits. The $500 million in grants from the State of California and the federal government’s renewal of PPP and the roll out of grants for live venues will be vital to the recovery of San Diego County businesses in the New Year.”

The deadline to apply is January 8, 2021 at 11:59 p.m. This is not a first come first serve grant. All applications will start to be reviewed following the closure of the application period. These grants are to cover business expenses and specifically for small businesses hit by the pandemic.

The new round of PPP is now open for both new borrowers and certain existing PPP borrowers. To promote access to capital, initially, only community financial institutions will be able to make First Draw PPP Loans on Monday, January 11, and Second Draw PPP Loans on Wednesday, January 13. The PPP will open to all participating lenders shortly thereafter. Updated PPP guidance outlining Program changes to enhance its effectiveness and accessibility was released on January 6 in accordance with the Economic Aid to Hard-Hit Small Businesses, Non-Profits, and Venues Act.  Learn more HERE.

This round of the PPP continues to prioritize millions of Americans employed by small businesses by authorizing up to $284 billion toward job retention and certain other expenses through March 31, 2021, and by allowing certain existing PPP borrowers to apply for a Second Draw PPP Loan.

“The historically successful Paycheck Protection Program served as an economic lifeline to millions of small businesses and their employees when they needed it most,” said Administrator Jovita Carranza.  “Today’s guidance builds on the success of the program and adapts to the changing needs of small business owners by providing targeted relief and a simpler forgiveness process to ensure their path to recovery.”

“The Paycheck Protection Program has successfully provided 5.2 million loans worth $525 billion to America’s small businesses, supporting more than 51 million jobs,” said Treasury Secretary Steven T. Mnuchin.  “This updated guidance enhances the PPP’s targeted relief to small businesses most impacted by COVID-19.  We are committed to implementing this round of PPP quickly to continue supporting American small businesses and their workers.”

Key PPP updates include:

  • PPP borrowers can set their PPP loan’s covered period to be any length between 8 and 24 weeks to best meet their business needs;
  • PPP loans will cover additional expenses, including operations expenditures, property damage costs, supplier costs, and worker protection expenditures;
  • The Program’s eligibility is expanded to include 501(c)(6)s, housing cooperatives, direct marketing organizations, among other types of organizations;
  • The PPP provides greater flexibility for seasonal employees;
  • Certain existing PPP borrowers can request to modify their First Draw PPP Loan amount; and
  • Certain existing PPP borrowers are now eligible to apply for a Second Draw PPP Loan.

A borrower is generally eligible for a Second Draw PPP Loan if the borrower:

  • Previously received a First Draw PPP Loan and will or has used the full amount only for authorized uses;
  • Has no more than 300 employees; and
  • Can demonstrate at least a 25% reduction in gross receipts between comparable quarters in 2019 and 2020.

Great News! On July 14, City Council approved the Temporary Outdoor Business Permit that allows restaurants and other businesses to expand onto sidewalks, parking lots and into parking spaces.  This extends the Mayor’s Executive Order (July 7, 2020) which encouraged restaurants to set up tables and chairs onto the PROW (Public Right of Way).  The goal is to make this a semi-permanent option as long as social distancing orders are in place. The City has set up a fantastic and comprehensive website that will answer all of your questions about this program as well as link you to a very simple permit application.  If you are located in the La Jolla Business Improvement District the City has granted La Jolla Village Merchants Association the ability to review and grant permits for SIDEWALK CAFES only.  By helping with this process, City Staff can tend to the more complicated applications such as “parklets.”

Need more space due to Social Distancing orders? Restaurants, retailers and other businesses can apply to expand onto the sidewalk or street using an online application.  This permit will allow for the temporary use of a street, sidewalk, parking lane or private property for business. he San Diego City Council will consider this interim urgency ordinance in as early as July 7, 2020.

The Temporary Outdoor Business Operation Permit supports the recovery of local retail outlets and restaurants devastated by economic impacts from COVID-19 by helping businesses with limited footprints operate in outdoor settings adjacent to their businesses and get closer to the sunshine. The goal is to help dining and retail outlets with space constraints expand operations outdoors so they can cost-effectively implement safety, health and distancing protocols.


Requirements & Conditions

The permit will temporarily allow for the expansion of outdoor dining and retail on to the public right-of-way, private parking lots or public spaces.

Issuance of the temporary permit will be subject to new guidelines or mandates for public gatherings and social distancing in accordance with the County of San Diego public health ordersCalifornia Department of Public Health guidelines and Centers for Disease Control and Prevention guidelines. As with all guidance that relates to COVID-19 response, permit requirements will be regularly evaluated or updated to respond to any changes to ensure the public health and safety.

Eligible Businesses

The following businesses with an active business tax certificate and all other applicable license or permits may apply:

  • Eating and drinking establishments
  • Retail and wholesale businesses

Eligible Locations

A temporary permit may be granted to conduct business outdoors on:

  1. Private property, including off-street parking lots, patio areas, and yards. This will also be for sit-down dining or customer pick-up and carry-out service while avoiding congregating, equipment sharing or sound amplification.
  2. Public rights-of-way, sidewalks, street parking spaces and possibly closing select streets.

As we move forward through various reopening protocols and procedures, La Jolla Village Merchants came together (six feet apart) to be part of video compilation produced by La Jolla resident, Ben Roberts, owner of Not Boring Entertainment.  “I love La Jolla,” explained Ben when he reached out to La Jolla Village Merchants Association at the beginning of May.  “I wanted to do something to help and storytelling is what I do!”  Ben, along with Artist Mika de la Cruz and LJVMA board members, Morgan Barnes and Melissa Snook spent an entire afternoon capturing footage of La Jolla’s essential business owners.  Enjoy the video!

Your La Jolla Village Merchants Association is here to help as you adapt to new guidelines  For instance, we have created posters to help you meet Signage Requirements which state::

  • Signage at each public entrance of the facility to inform all employees and customers that they should: avoid
    entering the facility if they have a cough or fever; wear facial coverings, maintain a minimum six-foot distance
    from one another; and not shake hands or engage in any unnecessary physical contact.
  • Signage posting a copy of the Safe Reopening Plan at each public entrance to the facility.

San Diego Volunteer Lawyer Program (SDVLP) is pleased to announce the launch of our COVID-19 Brief Legal Advice Clinic to help San Diego small businesses and nonprofits cope with the pandemic.

Volunteer attorneys will provide remote consultations to eligible businesses and nonprofit organizations on legal issues arising out of the pandemic, including questions relating to employment law, commercial leases, insurance, contracts, bankruptcy/restructuring, applications for financial assistance, and more. Consultations will last up to 45 minutes and are provided free of charge.

This checklist is intended to help retail employers implement their plan to prevent the spread of COVID-19 in the workplace and is supplemental to the Guidance for Retail Employers. This checklist is a summary and contains shorthand for some parts of the guidance; familiarize yourself with the guidance before using this checklist.

You can see the entire “Resilience Roadmap” HERE which includes guidelines for all business sectors. As you know, everything is fluid and your ideas and suggestions can be submitted by completing this California Recovery Roadmap Survey. 

In addition, the San Diego Tourism Authority has compiled a comprehensive list of guidelines for Safely Reopening San Diego specifically related to travel, tourism and hospitality.  Of course guidelines may change based on the dynamic COVID-19 data, compliance, consumer behavior and community input.

Starting Friday, May 8, some local businesses can begin to reopen if they have a plan in place to protect their employees and the public.

The San Diego County Board of Supervisors today voted to adopt the Business Safety Framework, a general outline for local businesses highlighting the things they need to prepare for and do before they could reopen. The supervisors also requested that the County’s chief administrative officer ask Gov. Gavin Newsom to provide the County with the autonomy to make region-related, COVID-19 decisions.

The goal of the framework is for businesses to be ready to reopen when authorized by the governor, who is expected to announce guidance on May 7.

But before businesses can reopen, they need to create a Safe Reopening Plan. A template is available now to review, but may be updated depending on direction from the state. Businesses will need to complete, print and post the plan at their entrance.

They also must ensure proper sanitation, physical distancing and general business practices and communication.

The governor announced that retail and manufacturing businesses with curbside pick-up will be allowed to reopen because they represent a lower risk of spreading COVID-19. Among them:

  • Bookstores
  • Clothing stores
  • Toy stores
  • Florists
  • Sporting goods

The impacts of COVID-19 have been felt in almost all corners of the regional economy. From retail to entertainment and manufacturing, industries across the spectrum are doing their best to weather the current storm of uncertainty. As many begin thinking and planning for a future where current restrictions begin their process of safely loosening, questions remain about what that process will look like and how different industries will have to adapt.

SDG&E recognizes the tremendous economic and human impact the coronavirus has had on our business community and we want all customers to know that SDG&E is here to help them through this crisis and support their energy needs. In recent weeks, they’ve taken several actions to support our region’s businesses.

  1. SDG&E is temporarily waiving late payment fees for business customers whose finances have been affected by the coronavirus.
  2. Recognizing the economic devastation caused by the pandemic, SDG&E has suspended service disconnections due to non-payment. This disconnection freeze will remain in place until further notice.
  3. If you or anyone you know is struggling to pay their energy bill, please contact SDG&E to learn about assistance programs or to set up flexible payment arrangements at 800.411.7343.

Many businesses are also trying to take care of their employees at this difficult time. SDG&E has bill discount programs to support customers year-round. Many people who previously did not qualify for these income-based programs may now be able to do so due to lost wages. Those who recently lost their job, even if they are receiving unemployment benefits, may be eligible for CARE and or FERA which can save customers up to 30% or more on their monthly energy bill. If you have a qualifying medical condition, customers may qualify for a bill discount with the Medical Baseline program. The Low-Income Home Energy Assistance Program (LIHEAP) is federally funded and helps low-income households with their energy bills. For more information on LIHEAP visit 211sandiego.org.

Jenny and Mike Eastwood thought their dream had come true. After four years of selling their artisan American-made cheeses solely at the La Jolla Open Aire Market, the Windansea residents were finally able to open their first brick and mortar at 7524 La Jolla Blvd.

That was three weeks before the shelter-in-place order.

Smallgoods Cheese Shop & Café was too small to benefit from the government’s Paycheck Protection Program and the Eastwoods have yet to hear back about the U.S. Small Business Association loans they applied for. “The only assistance we’ve received have been in the form of words of encouragement from customers, friends and complete strangers who thank us for staying open and hope we make it to the other side,” Mike said.

Yet the Eastwoods are still thinking of less-fortunate businesses during this unfortunate time. On Tuesdays and Thursdays, they have Escondido’s Heritage Farms to sell its produce in a micro-market in front of their store. “They rely solely on farmers markets, which don’t draw as many customers anymore,” Jenny said. “I’m incredibly passionate about our farmers. Whatever we can do to help and get some money into their pockets, that’s what we want to do.”

The Eastwoods are also helping the owners of the creameries with whom they’ve cultured relationships over the past four years. “Many have asked me to take on some of the inventory they can’t get to market because truckers are getting sick and clogging the distribution channels,” Jenny said. “All these small artisans are all looking to help each other.”

Both Girard Avenue stores are using the internet for sales promotions this coming week. Rangoni’s is a virtual wine/spritzer party and runway show via Zoom. From 4 p.m. to 5 p.m. Monday, April 27, models will don Rangoni’s best-selling Valentina and Amalfi shoe and handbag lines. Also scheduled is a drawing for a handcrafted handbag and a pop-in by owner Carolina Rangoni from Florence, Italy.

What viewers choose to do from the comfort of their own homes is their business, but Wyno says he hopes it involves taking advantage of his website’s 20 percent off spring/summer sale, which ends April 30, and imbibing wine or spritzers.

“I’m not encouraging people to get virtually drunk,” Wyno said, “but it would be fun. We did it in Oregon at Zelda’s Shoe Bar and it got to be crazy.”

Tuesday and Wednesday, April 28 and 29, J.McLaughlin’s will hold a “Virtual Sip & Shop” hosted by Las Patronas president Kelly Kjos. From 10 a.m. to 6 p.m., the store will provide curbside pickup or home delivery for all purchases, with 20 percent of the proceeds benefiting Las Patronas.
